Terms and Conditions
Please read the Terms and Conditions of The Global Travel Academy (“GTA”) carefully before submitting your enrolment. By submitting your enrolment you certify that you agree to the following GTA Terms and Conditions.
1. Educational Services
GTA is provider of online education services (“Services”) with a focus on international travel. We act as such by creating and hosting courses (“the Course”), and making them available to users via the internet. As a user, you can access our Services via the GTA website and must provide truthful information to GTA at all times.
You agree to use our Services only for lawful purposes and you may not use any part of them for commercial purposes. You may only utilize the Services in a way that does not infringe the rights of any other user, or restrict or inhibit anyone else's use. We reserve the right to suspend or cancel your access to our Services at any time at our reasonable discretion or if the rights of any other user are infringed.
2. Purchase and Fees
Submitting your enrolment is confirmation of your wish to purchase an online course from GTA. the Course will be made available to you once your payment has been received by GTA and GTA shall be under no obligation to provide access to the Course until all applicable fees have been paid.
All prices are expressed in US Dollars and payment details, such as credit or debit card information, are not stored by GTA. Payment is made via PayPal and by making a payment you certify that you understand and agree to PayPal’s User Agreement.
3. Refund Policy
GTA offers courses that are provided as an all-in-one software package, which means that once enrolment fees are paid access to the Course is final. We do not provide a refund of any enrolment fees or other fees paid regardless of whether you complete the Course once enrolled. Users who are removed from the Course for breaches in any of these Terms and Conditions are not eligible for a refund of any kind.
4. Availability of the Services
Although we aim to offer you high quality Services we cannot promise that the Services will meet your specific needs or be fault-free. If an error or fault occurs with the Services then we will take reasonable steps to resolve the issue and restore the Services as soon as we reasonably can.
5. Academic Integrity
You are expected to complete any assignments, quizzes, and assessments independently. If you are found to have committed plagiarism, you will be removed from the Course and will not be awarded a certificate. In accordance with clause 3, no refund will be offered if you are removed from the Course.
6. Course Expiry
In order to receive a certificate of completion from GTA, for any course that is offered, you are required to successfully complete all aspects of the Course (including unit-end assessments and the final assessment) within twelve months of receiving your course login details from GTA. If you fail to complete the Course within this term, you will not be awarded a certificate of completion and, in accordance with clause 3, will not be eligible for a refund.
7. Website Terms of Use
Through your use of the GTA website (“the Site”) you agree to be bound by these Terms of Use, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from GTA. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Use.
8. User License
Unless otherwise stated, all content on the Site is owned by The Global Travel Academy Limited and our affiliates or licensors, and is protected by copyright and other intellectual property rights. The Site is provided solely for your personal, noncommercial use. You may not download the materials (information or software) from GTA’s website and you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on GTA’s website or courses;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or mirror the materials on any other server.
- This license shall automatically terminate if any of these restrictions are violated, if your access to the Services is suspended or canceled for any other reason, and may be terminated by GTA at any time. Upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
9. Revisions and Errata
The materials appearing in any of GTA’s Services or website could include technical, typographical, or photographic errors. GTA does not warrant that any materials are accurate, complete, or current. GTA may make changes to materials contained at any time without notice. GTA does not, however, make any commitment to update the materials.
10. Disclaimer
The Services and all materials provided on GTA’s website are provided as is. GTA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, GTA does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Services or materials on its Site or otherwise relating to materials on any sites linked to the Site.
11. Limitations
In no event shall GTA or its suppliers be liable for any damages (including, without limitation, damages for personal injury or loss of property, loss of data or profit, or due to business interruption) arising from the use or inability to use our Services.
12. Terms and Conditions Modifications
GTA may revise these Terms and Conditions at any time without notice, include the website Terms of Use. By using the Site or our Services, you agree to be bound by any updated version of these Terms and Conditions.
13. Miscellaneous
GTA reserves the right to use feedback and images provided or shared by those who use our Services for marketing and promotion purposes, within the bounds of our Privacy Policy.
11. Governing Law
These Terms and Conditions and the Services provided pursuant to these Terms and Conditions will be governed by the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the New Zealand Courts.
